Guo Bin graduated from the University of Sheffield in 1997 prior to being admitted as an Advocate & Solicitor of the High Court of Malaya in 1999.
Guo Bin commenced legal practice with Messrs. Cheang & Ariff upon his call to the Bar in 1999. Guo Bin then joined Messrs. Logan Sabapathy & Co. in 2001 where he was appointed as a partner in 2007. In 2008, Guo Bin co-founded the firm of Messrs. Izral Partnership, where he remained in active practice until August 2022.
Guo Bin joined Messrs. Fahri, Azzat & Co. as a partner in September of 2022.
Guo Bin’s client portfolio includes well-known property developers, investment holding corporations, news & media groups, and multi-national corporations (both local and foreign).
Guo Bin’s practice involves general civil and commercial litigation with focus on corporate disputes, employment disputes (with emphasis on asset preservation and asset recovery for corporate employers), construction disputes, land disputes (including compulsory acquisition) and strata management disputes.
He is known for his willingness to go the extra mile for his clients – to sit with them and help build a case from the ground up. His focus on solution-oriented methods is reinforced by his innate disposition for scrutiny and inquiry, which manifests itself in the high standards of client-care and effective advocacy that he sets for himself.
His intuition and resolve for problem solving has served him particularly well, especially in matters involving discreet and concealed evidence. One such instance was in a cross-border matter where he successfully acted for an internet domain name vendor involving issues of fraud, conspiracy, and misappropriation of company properties by its former employees. Despite the cross-border jurisdictional issues involved in the asset recovery and digital evidence collection process from China, Guo Bin had successfully obtained an Anton Piller Order and a Mareva Injunction for the client.
Guo Bin also has a holistic experience in dealing with construction disputes in court, arbitration, and adjudication. Such disputes range from claims concerning variation orders and claims for additional payment, extension of time applications/claims as well as a claim by a subsidiary of a public listed developer against a concrete supplier for supply of non-compliant concrete affecting the entire development. In particular, Guo Bin has successfully acted for a leading public listed company from the High Court all the way to the Federal Court to enforce the call of a RM 50 million bank guarantee in the face of numerous attempts by the contractor to restrain the call and receipt of the bank guarantee on grounds that the contractual completion period to deliver the building had been extended by virtue of alleged variation orders.
As for compulsory land acquisition matters, Guo Bin has successfully increased compensation for injurious affection for a client from nothing to RM 8.3 million. Previously, he had also successfully moved the Court of Appeal to declare an acquisition of a client’s land by the Government to be null and void altogether on grounds of illegality. He then went on to successfully defend this declaration before the Federal Court.
On strata management disputes, Guo Bin acts for both parcel owners asserting claims against errant developers/joint management bodies (JMB)/corporations as well as for developers in defending such claims. He is currently involved in 2 large and complex disputes on both sides of the divide with issues ranging from charging of different rates of maintenance charges for different parcels, misuse of maintenance and sinking funds, fraudulent non billing of maintenance charges and sinking fund involving developer’s related parties, defending claims by a JMB attempting to claim parts of development as common property as well as attempting to set aside past utility charges by the developer and seeking to impose past maintenance charges and sinking fund on the developer which are alleged not to have been billed in the past.
On corporate disputes, Guo Bin is experienced in handling corporate shareholder disputes (in particular private family companies) and is presently acting and advising in a shareholder’s dispute of one of the largest private property developers in Malaysia.
On employment matters, Guo Bin regularly acts for employers on matters concerning on employee misconduct in particular that involving stealing/misappropriation of funds and recovery of such stolen funds, domestic inquiry proceedings and has been appointed to chair domestic inquiry proceedings. He is also regularly appointed by private companies as Chairman of Domestic Inquiry panels in dealing with misconduct hearings involving high level management personnel.
On defamation matters, Guo Bin regularly acts for a leading news and media group in fielding demands as well as defence work against defamation claims.
Owing to all the above, Guo Bin has been a ‘Recommended Lawyer’ in The Legal 500 (Asia Pacific) 2022 – which has recognized him to be a “key partners” of Izral Partnership with client testimonial in the following terms:
“Wong Guo Bin has the ability to provide clear and concise advice that is to the point. He is able to grasp the issues quickly and is a steady hand even in the heat of battle. Will jump into the trenches with you until the war is won.”
— The Legal 500 (Client Testimonial)
Outside of the courts, Guo Bin is also regularly appointed onto the Disciplinary Committee by the Advocates & Solicitors Disciplinary Board to investigate into disciplinary complaint made against lawyers.
Besides frequently conducting civil, corporate and construction cases at the High Court, Guo Bin has also been appointed as counsel for various legal areas at Court of Appeal and Federal Court level in his 24 years of practice. He was involved with a diversity of contentious and non-contentious matters. Some of his notable reported cases are as follows:
(a) Civil Procedure: Bukit Melita Sdn Bhd v Revolusi Rancak Sdn Bhd [2020] 2 CLJ 199, CA, Mann Holdings Pte Ltd & Anor v Ung Yoke Hong [2019] 6 CLJ 475, CA, Yoong Sze Fatt v Pengkalen Securities Sdn Bhd [2010] 1 CLJ 484, CA, Ali Tan Sri Abdul Kadir & Ors v Simpang Empat Plantation Sdn Bhd [2008] 5 CLJ 305, FC.
