Members of Fahri, Azzat & Co. have long experience of advising on company law issues, both arising in the course of commercial litigation, or of a more specialist nature. We cover all aspects of company law — from formation to dissolution, including mergers and acquisitions, corporate finance, reductions and reorganisations of capital, Bursa Saham and other regulatory requirements, meetings, directors’ duties, shareholder rights and remedies, and all other aspects of company law. By specialising in this way, we have been able to build up a common fund of expertise in areas of law and practice that the text books and reported cases often do not cover.

As well as providing advice on corporate governance issues generally, including members advise on individual rights and responsibilities under company law (including on potential breaches of fiduciary and directors’ duties). Members also undertake litigation in relation to restructuring issues and advise on related areas such as insolvency law. We regularly deal with company disputes ranging from shareholder actions, (including unfair prejudice petitions) to complex company director disqualification proceedings.

The Companies Act 2016 involves the most significant exercise of amending and consolidating company law for generations. It raises numerous new issues to vex company lawyers. As specialists in this area, members of Fahri, Azzat & Co. are well placed to deal with these issues.
